Ban & Unban Moderator xManY ignoring the rules?

xManY refused to ban user kabalah. and i would like to know why.
When you look at the thread How to post a Ban Request http://playdota.eu/forum/index.php/topic,5867.0.html you will see the rules that are written that will result in ban.

<plugging / Gproxy+ abuse / AFK / insulting / game ruining / intentionaly feeding / save game abuse / spaming / share abuse / family related flame / national intolerance / religion intolerance / racism / cheating / ban avoiding / inappropriate nickname /

The user kabalah. http://playdota.eu/stats/player/1/kabalah. broke the following rules while playing on PD server insulting / family related flame / national intolerance / racism by whispering this to me http://i.imgur.com/kgq4V.jpg "I think i fuck your dead turk mom? Do you?"

This is the answer i got "ZzZ report him eurobattle.net".
Rules of http://playdota.eu were broken and the answer i got is Go report him somewhere else. My question is why did you write those rules on this site if they only apply somewhere else?

Flaming is banned by playdota as long as it in game and he whispered you which isn't pd problem now it's eurobattle.com problem

We do not punish flame via whisper. If you are being flamed via whisper, report on eurobattle.net.

Our Complain's Board isn't working atm, so if you have any problems with mod, contact his boss but in this case xMany didn't ignored rules or his obligations.

As previous people said we do not ban flame via /w . Best solution is to make a ban request for him at http://eurobattle.net/ .

He didn't break ingame rules or channel rules so he didn't ignore PD rules , i don't know about xpam but he is ok till now with  PD . Everybody goes on rage he must have had his motive .

Ok. So you can only report stuff that happens in game chat/ lobby chat. Whispering isnt considered part of the PD system. Tnx for clarification.
