Question on Game Rule #7

7. Player must not ruin the game by:
      -Refusing to play
      -Intentionally Feeding
      -Sabotaging Teamates

At 24 minutes, redneck. (Techies) respawns and decides to mine up the fountain. Technically he isn't afk and therefore '4. Player must not AFK;' won't take place, but would this count as 'Refusing to play?'
He was there for the rest of the game (13min/game length was 37min). Sent was losing but hadn't been raxed yet, and he could have defended the hill with his help.
So I ask, would this count as anything under Rule #7?

yep it is afk , refusing to play,if he doesnt leave from 1 place, even if hes moving from time to time
