well u cant enter bnet without the new patch, so server must work with the new patch..

When you try to enter bnet without new patch, and you cant, mean that server must have new patch, and dont want to let you in, becouse you have old patch, and server wount cooperate with your patch, then you must work on new patch, to enter bnet wich work with new patch only.
